Ti’Cheri Desserts LLC Terms and Conditions
Definitions
The following terminology applies to these Terms and Conditions, Privacy Policy and Disclaimer Notice and any or all Agreements: “Customer”, “Client”, “You”, and “Your” refers to you, the person accessing this website and accepting Ti’Cheri Desserts’ terms and conditions. “Ti’Cheri Desserts”, “Ourselves”, “We” ,and “Us”, refers to Ti’Cheri Desserts. “Party”, “Parties”, or “Us”, refers to both the Customer and ourselves, or either the Customer or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Customer in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Customer’s needs in respect of provision of Ti’Cheri Desserts stated services/products, in accordance with and subject to, prevailing United States Law. Any use of the above terminology or other words in the singular, plural, and/or he/she or they, are taken as interchangeable and therefore as referring to same.
General
Ordering from Ti’Cheri Desserts you agree to be legally bound by these “Terms and Conditions” and accept that these “Terms and Conditions” may be modified or amended and posted on this website at any time.
Cake/Dessert Design
Client agrees to give Ti’Cheri Desserts the freedom of creative changes of the decided design for the sake of stability, structural integrity, or other certain emergencies. Client also understands that although Ti’Cheri Desserts will do its best to match specific colors, that color matching is not easily perfected. Different mediums such as buttercream and white chocolate have a yellow tint, and will affect the process of color matching. Client also understands that cake/dessert design is a creative art form, and therefore final design is an interpretation of the agreed upon design.
Design Changes
Changes to client’s cake/dessert order such as size, colors, flavors, and design will be accepted until 2 weeks prior to the event date. After that date, Ti’Cheri Desserts cannot accept any changes. All changes to existing orders must be made in writing through email. Any changes made by the client prior to two weeks of event date may affect the original pricing. Ti’Cheri Desserts reserves the right to increase or decrease price based on any changes made to the design, size of tiers, etc.
Non-Edible Items
Ti’Cheri Desserts will not be responsible for consumption of any non-edible items placed on your cake and/or dessert, such as flowers, wires, pearls, ribbons, etc. Any non-edible items must be removed by the client before the cake and/or dessert is consumed. Ti’Cheri Desserts is not responsible for any fresh flowers or cake toppers that go on the cake and/or desserts. Fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Client is also acknowledging and responsible for all “non-toxic” items chosen for order such as disco dust and luster dust that is not edible but for enhancing decorating use only.
Allergy Disclaimer
Our products may contain or encounter milk, wheat, nuts, soy, and other allergens. Client agree to notify guests of this risk and hold Ti’Cheri Desserts harmless for allergic reactions or any medical issues that may arise from consuming the product. Client is to disclose any known allergen of them or their guests at the time of consultation. However, due to cross contamination, Ti’Cheri Desserts can never guarantee that product is 100% free of allergens. Client understands in the case of an extreme allergen or medical condition, Ti’Cheri Desserts strongly encourages the client orders through another specialized baker.
Cake/Desserts Consumption
Cakes/Desserts should be consumed within 24 hours of the day of the event to guarantee freshness. Cake/Desserts care instructions will be added to your cake/dessert containers/boxes. Instructions can also be found on this website under “Cake Info”. It is the client’s responsibility to read the instructions. Cake/Desserts care instructions is a guide on how your cakes/desserts will develop best flavor and texture and how to safely transport your cakes/desserts.
Pick Up
At this time, Ti’Cheri Desserts does not offer delivery. An agreed time and date for pick up of cake and/or desserts will be discussed between client and Ti’Cheri Desserts. Please arrive on time for your confirmed date and time of pick up. If your order is not picked up within a 15-20 minute window from the time confirmed, client will be subject to a late fee. Client or client’s elective assume all liability and responsibility for the condition of the cake once it leaves Ti’Cheri Desserts’ possession. Ti’Cheri Desserts will provide instructions that will assist with transporting cakes and/or desserts.
Deposit
Client is required to pay a 50% non-refundable deposit within 24-48 hours of receiving an invoice. The deposit is paid to reserve your date and is non-refundable in the event of a cancellation. In the case that an event is changed to another date, there will be no additional charge for doing so. However, Ti’Cheri Desserts cannot guarantee that all accommodations can be made in the case of a changed date. Availability will be considered, as Ti’Cheri Desserts is only capable of a limited number of orders per week.
Final Payment
Final payment will be due two weeks before the event date. It is up to the client to send any payment(s) prior to the event date. If final payment is not received 7 days prior to the event date, Ti’Cheri Desserts will not be held responsible for completing the requested service, and will keep 50% of the payments made, or the non-refundable deposit amount (whichever amount is greater).
Cancellation Policy
In the event of a cancellation, Ti’Cheri Desserts will retain the non-refundable deposit that was paid. Client understands that Ti’Cheri Desserts can only accept a limited allotted orders per week, and must refuse clients in the case that the limit is met. In the event, something occurs to affect your scheduled event date, please contact Ti’Cheri Desserts immediately to discuss options. Ti’Cheri Desserts has every right to cancel your order. However, Ti’Cheri Desserts will do its best to accommodate your needs at Ti’Cheri Desserts’ discretion.
Final Sale/Refunds
All cakes/desserts are FINAL SALE. Full or partial refunds will be issued if an error is made by us, such as an error with size or flavor that was agreed upon. Refunds requested due to flavor and/or texture will be at the discretion of Ti’Cheri Desserts.
Photos
Ti’Cheri Desserts photographs their cakes and we reserve the right to use any photographs for display or promotion without compensation to the client.
Emergencies/COVID-19
In the event of unforeseen circumstances, such as acts of God, physical, family, and/or personal emergency, natural disaster, etc. that prevents Ti’Cheri Desserts from fulfilling an order, a full refund will be provided. Ti’Cheri Desserts cannot be held liable for more than the cost of the order.
COVID-19 safety guidelines and protocols are followed by Ti’Cheri Desserts. In the event an employee or employer of Ti’Cheri Desserts is exposed to COVID-19 and/or has a positive test result for COVID-19, client’s order will be cancelled immediately and a full refund will be provided. Ti’Cheri Desserts cannot be held liable for more than the cost of the order.
